Terms of Service

Sleep Tracker, Recorder(“Sleep Tracker, Recorder”) is an app developed by Healive Ltd.

By using the services provided by Sleep Tracker, Recorder, you agree to the following terms and conditions, and that you have read and fully understood the Terms of Service(“Terms of Service”) in this agreement in its entirety.

1. Accepting the Terms of Service

If you do not accept all terms in the Terms of Service, you must immediately discontinue using Sleep Tracker, Recorder and uninstall Sleep Tracker, Recorder from your device. 

2. Service

• You agree not to send pornography, violent, blooding, insulting, infringing, illegal or otherwise inappropriate content. What constitutes the above continent will be at the sole discretion of the developers of Sleep Tracker, Recorder.

• By using this app you are accepting the Terms of Service and Privacy Policy.

• You can not use the information gained from our app or users in an illegal or malicious way.

• You can not limit, or try to limit, the rights of other users to use our service. It is prohibited to encourage or give aid to others using this app in a way that is inconsistent with the terms of this agreement.

• If Sleep Tracker, Recorder determines a user is using this app in a way that is inconsistent with the Terms of Service, intentionally or unintentionally, Sleep Tracker, Recorder has the right to end service to that user and take legal action to protect the rights of Sleep Tracker, Recorder and its users if appropriate.

3. Copyright

You shall not copy any text, images or audios used in Sleep Tracker, Recorder app without the written consent of a Sleep Tracker, Recorder representative. Doing so may constitute infringement and put you at legal risk.

4. Limited Warranty

Sleep Tracker, Recorder does not represent or warrant that the app will operate without interruption or will be error free. Especially in the following cases:

(1) modification or alteration of the app made without the prior written approval of Sleep Tracker, Recorder,

(2) accident, neglect, misuse or abuse, or

(3) exposure to conditions outside the range of the environmental, power and operating specifications provided by Sleep Tracker, Recorder.

5. Prohibitions

You agree not to do any of the following:

·Post, upload, publish, submit or transmit any content that: (i) infringes, misappropriates or violates a third party’s patent, copyright, or other intellectual rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (vi) is violent or threatening or promotes violence or actions that are threatening to any person or entity; or (vii) promotes illegal or harmful activities or substances;

·Collect or store any personally identifiable information from the Application from other users of the Application without their express permission;

·Violate any applicable law or regulation.

You are solely responsible for all User Content that you post. Sleep Tracker, Recorder is not responsible for User Content nor does it endorse any opinion contained in any User Content. You agree that if anyone brings a claim against Sleep Tracker, Recorder related to User Content that you post, then, to the extent permissible under local law, you will indemnify and hold Sleep Tracker, Recorder harmless against all damages, losses, and expenses of any kind (including reasonable attorney’s fees and costs) arising out of such claim.

6. Change of Terms

This Terms of Service is subject to change at any time. Notices of any changes will be considered given and effective on the date posted on our app. The changes made will become effective the date they are posted. No further notice by Sleep Tracker, Recorder is required upon your continued use of our app or software.

7. Subscription Information

Sleep Tracker, Recorder offers an auto-renewing subscription to provide you with unlimited access to the VIP features.Your payment will be charged to your iTunes Account as soon as you confirm your purchase. You can manage your subscriptions and turn off auto-renewal from your Account Settings in the App Store after the purchase. Your subscription will renew automatically, unless you turn off auto-renew at least 24 hours before the end of the current period. The cost of renewal will be charged to your account in the 24 hours prior to the end of the current period. When canceling a subscription, your subscription will stay active until the end of the period. Auto-renewal will be disabled, but the current subscription will not be refunded. Any unused portion of a free trial period, if offered, will be forfeited when purchasing a subscription.
